Terms and Conditions of Participation in "THE LEADERSHIP BAY" Training
§ 1 Training Organizer

The organizer of "THE LEADERSHIP BAY" event (hereinafter referred to as "Training") is Play in DNA Sp. z o.o., located at ul. Marsz. Józefa Piłsudskiego 74/320, 50-020 Wrocław, NIP 8971947717, REGON 540640388 (hereinafter referred to as "Organizer").

These terms and conditions (hereinafter referred to as "Regulations") were issued pursuant to the provisions of the Act of 23 April 1964 - the Civil Code (consolidated text: Journal of Laws of 2016, item 380, as amended, hereinafter referred to as the "Civil Code") and are consistent with the Act of 30 May 2014 on consumer rights (Journal of Laws 2024.0.1796, consolidated text - the Act of 30 May 2014 on consumer rights, hereinafter also referred to as the "Consumer Act").
§ 2 Purpose of the Regulations

The Regulations are addressed to all persons who will be present at the Training Site during the Training. Each person who has obtained the right to participate, as well as each person who is present at the Training Site, is obliged to comply with the provisions of these Regulations.

The purpose of the Regulations is to ensure the safety of the Training by defining the rules of conduct of persons present at the Training and their use of the Training Site, as well as the devices and equipment located therein, and also to regulate the rights and obligations of the participants of the Training in connection with the registration of participation.

The following terms used in the Regulations shall have the following meanings:

"Regulations" – means these Regulations;

"Training Site" – means the designated locations where the Training takes place, or another place to which the Training may be moved for important reasons and made public before the Training;
-
"Participant" – means any natural person who turns 18 on the day of the Training at the latest, who has acquired the right to participate by making a payment to the indicated bank account number of the Organizer, and at the same time is staying at the Training Site during the Training;

"Functional Person" – means any natural person who takes direct part in the organisation of the Training, i.e. the Organiser and third parties cooperating with him.

§ 3 Registration

Anyone who is granted the right to participate in the Training is obliged to carefully read these Regulations and accept these Regulations. Only persons who have paid the fee for participation in the Training will have the right to participate in the Training.

Participation in the Training is subject to a fee and is tantamount to acceptance of the terms of these Regulations.

The price of participation in the Training is PLN 9,450 net and includes:
-
Participant's participation in the workshops, which take place on the premises of the Sheraton Sopot Hotel;
-
Participant's participation in sailing training, which takes place on the premises of the Sopot Marina and the Bay of Gdańsk;
-
a set of gifts from a limited sailing collection – jacket, polo, hat, bag;
-
NWW insurance.

A refund of the fee is possible only in the event of cancellation or significant change of the time and place of the Event. In other cases, there is no possibility of refunding the fee for participation in the Training.

The Participant has the right to transfer participation in the Training to another natural person who will be 18 years of age on the day of the Training at the latest, provided that the written consent of the Organizer is obtained. Participation in the Training may be transferred to another person free of charge or for a fee, with the proviso that resale at a price higher than PLN 9,450 net (the purchase price of participation in the Training) is prohibited. A Participant wishing to transfer his/her participation in the Training to another person is obliged to inform the Organizer of this fact via the e-mail address: kontakt@leadership-bay.com. The Organizer is not a party to the purchase/sale agreement between the buyer and the seller and is not responsible for any discrepancies resulting from the resale of participation in the Training to another natural person.
§ 4 Conditions of Participation

A Participant is a person who:
-
turns 18 no later than on the day of the Training;
-
registers and pays the fee for participation in the Training, i.e.:
-
correctly completes and sends the registration form, available at https://leadership-bay.com;
-
accepts these Regulations;
-
agrees to the processing of personal data provided in the registration process for the purposes necessary to carry out the Training, in accordance with the Act of 29 August 1997 on the protection of personal data (consolidated text: Journal of Laws of 2016, item 922, as amended);
-
pay for participation in the Training by making a transfer under the title "THE LEADERSHIP BAY" within 7 days from the date of receiving confirmation from the Organizer of sending the application form, to the account number sent in the email confirmation;
-
have an introductory telephone conversation with the Organizer.

Due to the limited number of places and safety requirements, only the Organizer's confirmation of participation in the Training by email ensures the possibility of participation in the Training.

The Organizer reserves the right to refuse participation in the Training to a Participant who has not fulfilled all the conditions of paragraph 1 of this paragraph. A Participant whose registration has been assessed negatively by the Organizer will receive a full refund within 7 days of the announcement of the assessment. The assessment of the Participant by the Organizer is irrevocable and final, and the Participant is obliged to comply with this decision.

The Participant is obliged to inform the Organizer of any food intolerances, allergies or other food exclusions no later than 7 days before the start date of the Training. This information should be sent to the following e-mail address: kontakt@leadership-bay.com. Based on the information provided, the Organizer will make every effort to provide the Participant with a meal tailored to their needs. In the event of failure to report within the specified time, the Organizer does not guarantee the possibility of providing a meal in accordance with the Participant's individual needs and is not responsible for any inconvenience related to the lack of an appropriate meal.

The Participant of the Training hereby declares that:

before the start of the event, they will familiarize themselves with the event schedule and declare that they have no health contraindications to participating in the Training, in particular:
-
any circulatory system diseases;
-
any respiratory system diseases;
-
recently undergone surgeries;
-
-
they participate in the Training at their own risk and responsibility.

In the event of purchasing the Training on behalf of a third party, the Participant is obliged to inform this person of the provisions of the Regulations and the details of the purchased Training. By making a purchase, the Participant declares that they have informed the third party of the content of the Regulations. The Participant bears all liability for failure to comply with the provisions of the Regulations and the participation of a third party in the training.

Intellectual property rights used during or in connection with the Training are the property of the Organizer. Intellectual property rights in this respect are not transferred to the Participant.

Materials provided or made available to the Participant may be used by him/her only for personal use for educational and training purposes. The Participant is not entitled to duplicate materials or transfer materials or any other items constituting the intellectual property of the Organizer to third parties.

The Participant is prohibited from conducting trainings with content based on knowledge gained during events, as well as using a formula or scenarios similar to events organized by the Organizer.

The Participant is not entitled to record or record the course of the Training using audio or video recording devices.
§ 5 Safety Measures

In the event of any injuries, contusions, any serious health problems, including those described above and pregnancy - a doctor's consent must be provided stating that there are no contraindications and that it is possible to participate in the Training.

In the event of feeling unwell or any health problems, the Organizer or Official must be informed immediately.
-
Due to the voluntary nature of participation in the Training and the fact that the Organizer does not know the health status of the Training Participant, and the Training Participant participates in it at their own risk, the Organizer is liable to the Participant for damage caused by failure to perform or improper performance of the Training, if the damage is caused by the Organizer's wilful misconduct or gross negligence.

The Organizer ensures the safety of persons present at the Training and order during the activity. In the event of failure to comply with these Regulations by the Participants, the Organizer and Officials have the right to refuse entry to the Participant or stay in the Training Site.

The Organizer is obliged, in accordance with the provisions of the Act, to refuse entry to the Training Site:
-
to persons who refuse to undergo the activities referred to in paragraph 11 of this Section;
-
a person who is visibly under the influence of alcohol, narcotics, psychotropic substances or other substances with a similar effect;
-
a person in possession of a weapon or other dangerous objects, explosives, pyrotechnic products, fire hazardous materials, alcoholic beverages, narcotics or psychotropic substances;
-
a person behaving aggressively, provocatively or otherwise posing a threat to public safety or order.

It is strictly forbidden to:
-
bring in audio-video recording equipment and cameras, bring in and possess during the Training cameras, audio and video recording equipment, and photographic equipment that may be used professionally, including cameras with interchangeable lenses, and cameras with optical zoom above 6x. Tripods are not allowed, and photos must be taken for private purposes. Photographs should be taken in such a way as not to disturb people standing nearby. The use of flashes is not allowed;

bringing dogs and other animals into the Training Site;
-
bringing dangerous items, including weapons, firecrackers, flares, etc.;
-
bringing alcohol and narcotics;
-
bringing closed packages, parcels, etc.

The assessment of items and their classification as dangerous is the responsibility of the Officials designated by the Organizer. In the event that items are found in the contents of the luggage or clothing being inspected that are prohibited from being brought in or possessed during the Training, the Official will refuse to let that person into the Training.

Only a person with an identity card and confirmation of registration is allowed to enter the Training Site.

The Training Organizer may refuse entry to the Training and stay in the Training Site to persons:
-
not having confirmation of registration,
-
whose appearance makes identification impossible,
-
having damaged plastic, glass or metal containers or cans, etc.,
-
not having an identity document,
-
being under the influence of alcohol or other intoxicants.
-

Participants and all other persons present in the Training Site are obliged to follow the instructions of the Officials. Refusal to follow these instructions may result exclusively from their inconsistency with generally applicable provisions of law.

Participants of the Training Site and all other persons present in the Training Site are obliged to behave in a manner that does not endanger the safety of other persons present at the Event, and in particular to comply with the provisions of the Regulations. It is forbidden to destroy devices, equipment, signs and information boards, advertising media, located in the Training Site, etc. Participants are obliged to use sanitary facilities only in accordance with their intended purpose.

Functional Persons are authorized in accordance with the provisions of the Act to:
-
check the authorization to stay in the Training Site;
-
check the identity of persons in order to establish their identity;
-
review the contents of luggage, clothing of persons, in the event of suspicion that these persons are bringing or possessing items referred to in paragraph 6 of this Paragraph;
-
determine the authorization of persons to stay in the Training Site, and in the event of the lack of such authorization - to call them to leave the Training Site;
-
issue order to persons disturbing public order or behaving in a manner inconsistent with the Regulations, and in the event of failure to comply with these orders - to call them to leave the Training Site.

It is prohibited to conduct any commercial or other profit-making activity, as well as advertising and promotional activity, on the Training Site without the Organizer's authorization.

The Organizer ensures fire safety by ensuring that the Officials and the Organizer must know the location of hand-held fire extinguishing equipment and hydrants and the rules of conduct in the event of a fire.

The Organizer is not responsible for lost or left items, including in particular documents, money, jewelry, on the Training Site.

The Organizer does not keep a depository for valuables, in particular documents, money, jewelry, electronic equipment, payment cards, etc.; therefore, it does not take responsibility for items lost or left unattended on the Training Site.

The Organizer, to the extent specified in the Act and implementing regulations, is authorized to record the course of the Training, and in particular the behavior of people, using devices recording image and sound. Materials collected during the recording of the course of the Training, which may constitute evidence allowing the initiation of criminal proceedings or proceedings in cases of misdemeanours or evidence of significance for such ongoing proceedings, shall be immediately transferred by the Organizer to the district prosecutor competent for the Training Site or to the Police. Materials collected during the recording of the course of the Training, which do not contain evidence allowing the initiation of criminal proceedings or proceedings in cases of misdemeanours or evidence of significance for such ongoing proceedings, shall be stored after the end of the Training for a period of at least one month and then destroyed by the committee.
§ 6 Data Protection

In accordance with Article 13 paragraphs 1 and 2 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter referred to as "GDPR"), hereby informs that:

The controller of the Participant's personal data is Play in DNA Sp. z o.o., ul. Marsz. Józefa Piłsudskiego 74/320, 50-020 Wrocław, with the Tax Identification Number (NIP) 8971947717 and National Business Registry Number (REGON) 540640388.

The Participant's personal data, which consists of basic identification data, will be/are processed for the purpose of the Participant's participation in the "THE LEADERSHIP BAY" Training organized by the Organizer. In the event of expressing a desire to participate in the Training:

personal data may be disclosed on the basis of entrusting subcontractors of Play in DNA Sp. z o.o. providing accounting services to Play in DNA Sp. z o.o.;

The Participant's personal data will be processed for the period of participation in the Training organized by Play in DNA Sp. z o.o. and for the period necessary for Play in DNA Sp. z o.o. to perform its obligations under the law.

In accordance with the provisions of the GDPR, the Participant has the following rights:
-
the right to request access to their personal data and to receive a copy thereof;
-
the right to rectify the Participant's personal data;
-
the right to request the deletion of the Participant's personal data and the right to request the restriction of the processing of such data;
-
the right to object to the processing of personal data by the Participant;
-
the right to transfer the Participant's personal data; and
-
the right to lodge a complaint with the Office for Personal Data Protection.

Providing personal data is voluntary, but necessary to participate in the organised Training.
§ 7 Complaints

Complaints regarding the Training may be filed within 14 calendar days of its completion. The Organizer reserves the right to leave complaints filed after the above deadline without consideration.

Complaints must be filed in writing by registered mail or in person to the Organizer's address.

The complaint should include:
-
Name/first name and surname of the person filing the complaint
-
Contact details of the person filing the complaint
-
Subject of the complaint (date, title of the Training, location)
-
Description of the circumstances justifying the filing of the complaint
-
Expectations towards the Organizer (re-performance of the service/part of the service; price reduction; compensation in the form of a reduction for the next service; other)
-

The Organizer will consider the complaint within 14 calendar days from the moment of its receipt. In justified cases (expert opinion, legal consultations, etc.), the time for processing the complaint may be extended, of which the person filing the complaint will be informed.

The complainant will be notified of the decision regarding the complaint by post, telephone or electronically.
§ 8 Final Provisions

The Organizer reserves the right to change the date, time and place of the Training. In the event of significant changes to the features of the Training indicated in the order, the Participant may withdraw from the contract.

The Organizer reserves the right to cancel the Training at any time, in which case the Organizer is obliged to return the fee for participation in the Training, paid by the Participants, within 14 working days from the date of cancellation of the Training, however, the refund applies only to the amount paid for participation in the Training (excluding travel and accommodation costs).

The Organizer does not guarantee the results of the Participant's use of the Training and is not responsible for any consequences of actions taken by the Participant as a result of the Participant's use of the Training.

These Regulations apply to the Organizer and the Participant from the moment of acceptance during the registration procedure for participation in the Training, i.e. sending the completed application form via the website: https://leadership-bay.com.

The invalidity of one or more provisions of the Regulations does not result in the invalidity of the entire Regulations. In such a case, the Parties undertake to replace the invalid provision with one that is similar in purpose.

In matters not regulated by these Regulations, the provisions of generally applicable law shall apply.
-
Any disputes arising from these Regulations shall be resolved by the Court of local and material jurisdiction.
